A machine that can only be repaired by permission is a machine with a business model embedded in its fault code.
In February 2026, the US Environmental Protection Agency issued guidance saying the Clean Air Act supports rather than restricts the ability of farm and non-road diesel equipment owners to make repairs. The EPA said manufacturers could no longer use the law to justify limiting access to repair tools or software.
The agency said manufacturers had interpreted anti-tampering provisions as a reason to keep essential tools inside authorised dealer networks. That turns a software gate into a delay: an owner can see the equipment, understand the urgent job and still be unable to fix it without the credential held by somebody else.
Safety is not a monopoly licence
The EPA says its guidance does not weaken emissions standards or change the law. It clarifies that temporary overrides are allowed when they are needed to repair equipment and return it to proper function. That distinction matters. A legitimate safety or compliance requirement can coexist with access to the diagnostic information needed to maintain the machine.
The strongest right-to-repair standard is boring: provide parts, manuals, diagnostics and software access on fair terms, while preserving the rules that protect people and the environment. Owners should not have to choose between compliance and getting back to work.
The technical choke point
Modern diesel equipment uses electronic control units, diagnostic ports and calibrated software. A repair may need a scan tool to read fault codes, test components, clear errors or run a service routine after a part is fitted.
The policy question is not whether anyone should alter emissions settings. It is whether access to diagnostics and a temporary repair state is available on fair terms so a machine can be restored to its compliant configuration.
